These general conditions of sale apply to all orders placed on the site www.jlrparis.com, an online sales site operated by JLR, SARL with capital of 38 112.25 euros, registered at RCS of Paris B 399 810 290 and whose head office is at 50 boulevard Malesherbes 75008 Paris - France (VAT number 80 399 810 290), hereinafter referred to as "JLR.”



ARTICLE 1 - USE OF THE WWW.JLRPARIS.COM WEBSITE

    1. www.jlrparis.com is a free access site. JLR implements security measures to protect its customers’ information and to provide its customers with reasonable security. The user is nevertheless cautioned that navigation of the www.jlrparis.com website is at your own risk and it is preferable to make purchases from a computer with updated antivirus software.

    1. JLR cannot be held liable for damages related to internet use, neither can they be held responsible, in case of inaccessibility to the site, of computer fraud committed by third parties and, more broadly, for any action likely to qualify as force majeure.

  1. In addition, it is expressly agreed that JLR will not be held liable for any direct or indirect damages, of any nature whatsoever related to www.jlrparis.com site usage.


ARTICLE 2 - PRICES

    1. The prices of products offered on the site www.jlrparis.com are indicated in euros with all taxes included, excluding shipping charges, which are specified when ordering.

    1. Orders placed on the site www.jlrparis.com, are paid in euros regardless of the country where the order is placed.

  1. JLR reserves the right to change its prices at any time. However, products will be billed based on the rates in effect at the time of order placement.


ARTICLE 3 - ORDERING

    1. Consultation and prior acceptance of all terms and conditions.
      These general conditions of sale are available for consultation before ordering. Placing an order on the site www.jlrparis.com assumes prior acceptance without objections of these conditions of sale, no orders can be registered until the customer has checked the box accepting the Terms and Conditions.

    1. Unavailability of products.
      The items displayed on the site www.jlrparis.com may become temporarily or permanently unavailable at the time of order. In the event that a product becomes unavailable after an order is placed, JLR strives to offer a comparable product to the customer. If in such a case, the client does not accept JLR’s proposition, the latter undertakes to repay the customer as stated in Article 5.

    1. Personal information.
      To provide the products and services you order, JLR is obliged to collect personal data. This information is available under “Your Account” on www.jlrparis.com. To ensure a high quality of service, the customer is encouraged to verify the accuracy of the data submitted and, if personal circumstances change (measurements, billing address, shipping address, etc.. ), to amend relevant data accordingly.

  1. Respecting the general conditions of sale.
    Anyone who infringes on any or all of these terms and conditions of sale is likely to see his personal account suspended or deleted.


ARTICLE 4 - CONFIRMATION OF THE ORDER

    1. Confirmation email.
      Every order placed on the site www.jlrparis.com is followed by a confirmation email, with a summary of the order.

    1. Sales contract.
      The product’s contract of sale will be deemed complete following the online payment of the order.

  1. Retention of data relating to purchases.
    Data for orders placed on the site www.jlrparis.com is recorded and archived by JLR. It is available in the "Your Account" area and provides proof of all purchases made on the www.jlrparis.com site.


ARTICLE 5 - AVAILABILITY OF FABRICS

    1. Unavailability of fabrics.
      The items displayed on the site www.jlrparis.com may become unavailable temporarily or permanently at the time of order. In the event that a product becomes unavailable after an order is placed, JLR strives to offer a comparable product to the customer. If in such a case, the client does not accept the proposal made by JLR, the latter undertakes to repay the customer. It is expressly agreed that the customer cannot receive any compensation other than reimbursement or replacement of the product, if the product was indeed paid for.

  1. Reimbursement.
    The reimbursement method mentioned in the preceding paragraph can be executed in a manner determined by JLR either by crediting the customer's bank account or by check within a maximum of fifteen days, starting from the date of the customer’s payment.


ARTICLE 6 - DELIVERY

    1. Delivery time.
      In France, products ordered on the site www.jlrparis.com are delivered within 15 working days starting from the date of full payment of the order.

    1. Delays.
      In the case where it would prove impossible to deliver the ordered product within the time period mentioned above, JLR will inform the client of any delay and deliver the ordered product within the statutory period of, at the most, thirty days after placing the order.

    1. Inaccurate data on the delivery address.
      Products ordered on the site www.jlrparis.com are delivered to the address provided when ordering. In accordance with Article 3§3, the customer is responsible for the accuracy of the data it conveys to JLR. JLR is not responsible in cases where the information submitted by the customer is inaccurate.

    1. Transfer of ownership and transfer of risk.
      Ownership of the ordered goods, and the burden of risk is transferred to the client starting with the handing over of aforementioned products to the customer.

    1. Objections.
      It is expressly agreed that only objections of non-compliance between the delivery of products received and the quantity of products ordered are admissible. In the case where the quantity of goods ordered does not conform to the quantity delivered, the customer must notify the transporter upon delivery of the product and send objections to JLR by email at contact@jlrparis.com within 12 hours. Any objections with the quantity of goods delivered must be notified to the transporter upon delivery of the product. A copy of the objections should be sent to contact@jlrparis.com no later than 12 hours after these objections have been made.

  1. Non-compliance of products.
    In the event of non-compliance of the products with the order, the customer must send a letter or an e-mail to JLR contesting the order. As appropriate, JLR will then proceed to exchange or alter the product. The request must be made within seven (7) working days following delivery of products. Any objections made after this deadline will not be accepted. Products must be returned to JLR in the state in which the client received them. The customer will be responsible for shipping costs.


ARTICLE 7 - PAYMENT

    1. Interface security system.
      Payments are made by credit card via a secure payment interface by SSL. You can verify that the transaction is secure by looking in the address bar of your browser, the address should begin with https:/ / or bring up a small lock (please note that some browsers may show the padlock in the bottom of your window). The bank details (card number, expiration date and security code) are transmitted to the bank Crédit du Nord without JLR or third parties gaining access. This information is not stored on JLR’s servers and can only be reused by JLR in the case of a refund.

    1. Debiting.
      The amount of the order is debited from the customer's account only after the validation of payment.

    1. Archiving of transactions.
      In accordance with Article 4-4 of these general conditions of sale, the information recorded and stored by JLR and the company operating the online payment service constitutes proof of the order and all transactions.

  1. Bills.
    Invoices for orders placed on the www.jlrparis.com site are available under "Your Account.”


ARTICLE 8 - RIGHT OF WITHDRAWAL

    1. The exclusion of personalized and made-to-measure products.
      In accordance with the provisions of Article L121-20-3 of the Consumer Code in the version following Ordinance No. 2005-648 of June 6, 2005, the right of withdrawal cannot apply to contracts for suppliers of property which is clearly personalized or made to the specifications of the consumer. Therefore excluded from the right of withdrawal are all personalized clothing, items and accessories. For customization, it is agreed to grant this exclusion to, in particular, the additions of initials, names, surnames, as well as made-to-measure clothing and accessories.

  1. Other products.
    The products which do not fall under the proceeding category are open to the right of withdrawal. In accordance with the legislation in force, the withdrawal right must be exercised within seven working days after receipt of order. When the right of withdrawal is exercised on property already delivered, it is up to the customer to return the goods to JLR, without having to provide any reason nor incur any penalty.


ARTICLE 9 - WARRANTY / LIABILITY

    1. Regulatory compliance.
      The products available on the site www.jlrparis.com comply with French legislation. JLR cannot be held liable for non-compliance with the laws of the country where the product is delivered, including for violation of a local rule restricting the right to import or use of products or services provided by JLR.

    1. Exclusion.
      JLR cannot be held responsible in the following cases: Delayed delivery, tearing, alteration of the fabric of any kind, strikes or in the case of force majeure as well as for all events for which JLR is not solely and directly responsible.

  1. The photographs on the site www.jlrparis.com are provided for illustrative purposes and are not legally binding unless otherwise mentioned.


ARTICLE 10 - REIMBURSEMENT
Repayment for a product ordered for one of the reasons envisaged in Article 8§2 is made by check or by bank account credit within a period not exceeding 30 days after receipt of goods by JLR.

ARTICLE 12 - PERSONAL DATA

    1. Processing personal data.
      To deliver its products and services, JLR is obligated to collect your personal data. This data is treated confidentially. It may however be disclosed to third parties so as to manage your order (companies providing online payment service, transport companies, IT service providers). When transmitted, the data is made anonymous within all possible limits. Moreover, each of the third parties with whom JLR transmits personal data is bound by a contract guaranteeing the confidentiality and security of transmitted data.

  1. Right of access, rectification and opposition.
    In accordance with the French Data Protection Act of January 6th, 1978, you have a right of access, rectification and opposition to personal data which concerns you. To exercise these rights, you can write to us by mail at JLR, 50 Boulevard Malesherbes 75008 Paris, indicating your name, email address and if possible your customer reference. Your request must be signed and accompanied by a photocopy of an identity card bearing your signature and the address to which the response should be sent. A response will then be submitted within one month of receipt of the request.


ARTICLE 13 - INTELLECTUAL PROPERTY
The texts, illustrations, photographs and models shown or depicted on the site www.jlrparis.com are the exclusive property of JLR and are protected by copyright. Any reproduction or representation, whether full or partial, of the www.jlrparis.com site or of one of the elements contained therein is strictly prohibited.


ARTICLE 14 - AMENDMENTS TO TERMS OF SALE
The general conditions of sale are subject to change. The conditions applicable are those that were in effect the day the order was placed. If modified, older versions of the general conditions can be found at www.jlrparis.com.


ARTICLE 15 - APPLICABLE LAW
This contract is subject to French law. Any dispute which may arise from the interpretation or execution of the contract will be subject to the jurisdiction of French courts.
